Terms and Conditions
1. Scope of Services
DTS Distribution ("we", "our", or "the company") provides logistics, freight forwarding, and distribution services including, but not limited to, national and international road transport, storage, and handling of goods.
2. Applicability
These Terms and Conditions apply to all agreements entered into with DTS Distribution unless otherwise agreed in writing. By engaging our services, the client ("customer") agrees to be bound by these terms.
3. Governing Law
All services provided by DTS Distribution are governed by Danish law, and in cases involving international transport, the applicable international conventions and regulations shall apply.
- Domestic transport is governed by the Nordisk Speditørforbund’s General Conditions (NSAB 2015).
- International transport is subject to the Convention on the Contract for the International Carriage of Goods by Road (CMR)
4. Liability
Our liability for loss, damage, or delay is limited in accordance with the applicable regulations, including NSAB 2015 and the CMR Convention.
- For freight forwarding services, liability is limited to 8.33 SDR per kg (approximately €10 per kg), as per NSAB 2015.
- We are not liable for indirect losses, including loss of profit, loss of business, or consequential damages.
5. Dangerous Goods
Transportation of dangerous or hazardous goods (ADR) must be declared in advance. Clients are responsible for proper packaging, labeling, and documentation in compliance with ADR regulations. We reserve the right to reject non-compliant shipments.
6. Payment Terms
Invoices must be paid within 14 days of the invoice date unless otherwise stated in writing. Late payments are subject to an interest charge of 2% per month and an administration fee.
7. Insurance
We recommend that clients take out appropriate transport insurance. DTS Distribution can arrange insurance upon written request, at the client’s expense. Unless otherwise agreed, shipments are not automatically insured by DTS.
8. Force Majeure
DTS Distribution is not responsible for delays, damages, or failures caused by circumstances beyond our control, including but not limited to natural disasters, war, strike, pandemic, or government restrictions.
9. Claims
Claims regarding loss or damage must be submitted in writing within:
- 7 days for visible damage
- 21 days for hidden damage
- Immediately for delays
All claims must be supported with sufficient documentation (e.g., photos, packing lists, invoices).
10. Confidentiality
Both parties agree to keep all commercially sensitive information confidential and not disclose it to third parties without prior written consent.
11. Disputes
In case of disputes, the parties shall first seek to resolve the matter amicably. If no resolution is found, the case shall be subject to the jurisdiction of the Danish courts, with Copenhagen District Court as the agreed legal venue.
